This BC / 100 visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. Usually, 2 years must have passed since you applied for the combined Subclass 309 and Subclass 100 visa for you to be assessed for the permanent visa. You must be outside Australia when you apply for this visa.

Partner Visa 100 Work Rights in Australia

The visa BC/100 holders have full work rights to work anywhere in Australia. Partner Visa Australia Subclass 100 is a permanent resident visa.

Partner Visa Subclass 100 Travel to and from Australia for 5 years

You can travel to and from Australia as many times as you want for 5 years from the date you are granted BC 100 Visa. This is as long as the travel facility on this visa remains valid. If you want to travel after the initial 5 year travel facility:
- You will need to apply for and be granted a Subclass 155 or Subclass 157 Resident Return Visa (RRV) so that you can re-enter Australia as a permanent resident.
- You can apply for Australian citizenship and if granted, can apply for Australian passport that you can use to leave and re-enter Australia.

Including Family Members in Subclass 100 Visa

If you have children, they can also be included in your subclass 309/100 Australia application at the time of application, or before a decision is made on temporary visa application. If you want to add a child after you have been granted Subclass 309 Visa, then you will need to lodge 'Subclass 445 Dependent Child Visa'. If you granted Subclass 100 Visa then your child can join you by lodging either 'Child Subclass 101 Visa' or 'Child Subclass 802 Visa'.

Subclass 100 Partner Visa Continue To Be in Genuine and Ongoing Relationship

To meet the relationship requirement for visa 309/100 Australia you and your spouse must both continue to be in committed shared life together to the exclusion of all others, your relationship with your spouse must be ongoing and continuing, you must live with your spouse or do not live apart on a permanent basis and your marriage must be valid under Australian law.

2 Year Waiver for Relationship Requirement for Subclass 100 Visa Australia

Usually, 2 years must have passed since you applied for the combined Subclass 309 and Sub Class 100 visa for you to be assessed for the permanent visa. If you were in a long-term relationship or your sponsor held a specific visa before you applied, you might be granted the permanent visa within less than 2 years.

Subclass 100 Partner Visa Australia Relationship Breaks Down

You might still be eligible for the BC100 visa if your relationship breaks down or your partner dies before the grant of permanent visa 100 Australia.

In family violence situations: If you or someone in your family is the victim of family violence, you could still get a Partner visa Subclass 100 if you came to Australia as the holder of a provisional Partner Visa Subclass 309; and your relationship has ended; and your partner committed family violence against you or a dependent child of you or your partner. Detailed documentary evidence that you may provide are prescribed in subclass 100 visa checklist.

You have a child with your sponsor: If your relationship ends and you have parental responsibility for at least one child under 18 years, you may still get a Partner visa Subclass 100 if you have applied for, or you came to Australia as the holder of a provisional Partner Visa Subclass 309; and your relationship has ended; and you have access to and/or responsibility for the child.

Your partner dies: If your partner has died, you could still get a visa bc 100 if you have applied for, or you came to Australia as the holder of a provisional Partner Visa Subclass 309; and you can prove your relationship would have continued if your partner was still alive; and you have close ties with Australia.

This prospective marriage subclass 300 visa allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to join their Australian citizen, Australian permanent resident or an eligible New Zealand citizen partner in Australia. This visa is applied by applicant's who are outside Australia at the time of application.

NZ Citizen Family Subclass 461 Visa
